Westchester County Police charged 38-year-old Michelle Sergio with felony second-degree Vehicular Manslaughter in connection with the death of Mangilardi in Ossining Tuesday night, according to a press release. Police lodged the charge in Yorktown Town Court in addition to the misdemeanor DWI Sergio received earlier this week.
Mangialardi was reportedly crossing Route 9A from the northeast corner of the intersection when he was struck by a Nissan Altima that was traveling northbound on Route 9A, according to a previous report from Westchester County Police. Mangialardi was "believed to have been at the intersection to erect campaign signs," according to the report. The 55-year-old Briarcliff Manor resident was pronounced dead at the scene.
"Sergio failed a field sobriety test and was taken into custody on a DWI charge at that time," according to the Friday report. "She consented to provide a blood sample. The analysis of that sample confirmed that Sergio’s blood alcohol level was greater than .08 percent, the legal threshold for DWI."
Sergio's case has been transferred to Yorktown Town Court at the request of the Ossining court, according to the report. She is set to be arraigned on the Vehicular Manslaughter charge at 6 p.m. Sept. 10 at Yorktown Town Court.
Sergio’s bail was recently reduced to $125,000 cash or $250,000 bond, which is down from the bail set Tuesday at $250,000 cash or $500,000 bond.
