The Westchester Board of Elections has not released its District 40 state Senate results due to voting-machine problems as workers recount the votes.
As of Friday, 179 out of 209 districts in Westchester, or 85 percent, had been counted. Wagner is leading Ball in Westchester, 36,334 to 33,328.
Ball’s campaign has argued that the lead of almost 7,000 votes he had gained in the Putnam and Dutchess portions of the district make it impossible for Wagner to win.
Wagner, a Croton-on-Hudson resident whose campaign office is on South Street in Peekskill, has argued that the remaining votes are from heavily Democratic districts and said Ball claimed victory too early.
"The race is too close to call," said Wagner campaign spokesman Steve Napier. "While all of the traditionally high-performing Republican areas have been fully counted, results in much of the traditionally Democratic areas of Westchester County have yet to be reported. We will pursue a full and fair count of all ballots, and we are confident that in the end Justin Wagner will be seated in the New York state Senate."
