NEW YORK, N.Y. -- A New York Judge has put a stop to New York City Mayor Michael Bloomberg's ban on super-size, sugary soft drinks.

Manhattan state Supreme Court Justice Milton Tingling ruled that rules of the law, which was to go into effect Tuesday, are "arbitrary and capricious," applying to only certain beverages and only certain stores, Fox News reported.

Bloomberg continued to defend the ban on Twitter after the ruling.

"Obesity kills more than 5,000 NYers each year. We must take bold steps to fight this crisis," he wrote.
