Westchester Woman Alleges Rape By Cop/Husband In Lawsuit

A Westchester woman is suing the city and the Yonkers Police Department claiming she was raped by her former husband - an officer with the department - and falsely arrested, according to a lohud report.

Marlaina Koller-Gurgigno of Yonkers is claiming that she was the victim of domestic violence at the hands of her estranged husband, Vincent Gurgigno, Jr. and that the police were aware, and did nothing to stop it, the report states.

 Koller-Gurgigno is seeking monetary damages, claiming that her civil rights were violated, she was forcibly raped, falsely arrested and has endured emotional distress.

According to the report, Koller-Gurgigno filed for divorce in March 2016, though that case is still pending. She alleges that in 2016, the two got into an argument over how much she shops. She contends that when she put her foot in the door to get back in, he struck her in the face and kicked her in the stomach before locking her out of the house.

Koller-Gurgigno attempted to press charges against Anna Gurgigno, but police refused, according to the report. Criminal charges against Koller-Gurgigno were dismissed several weeks later.
